What are the formalities of signing a power of attorney?

To sign a valid power of attorney, you must be in the presence of a notary and two witnesses, and you must be of sound mind. Typically, the attorney preparing that power of attorney for you will make the determination that you have the ability to sign this document, you know and understand the purpose of the document, and then will provide you with that power of attorney and obtain your signature with a notary and the two witnesses present.
