What are the disadvantages and advantages of a guardianship?
An advantage of a guardianship is you may be stopping somebody from using your assets inappropriately through a durable power of attorney or just coming in an unduly influencing you. A guardianship then would put a guardian in place to stop that. The guardian has to report how your assets are used and what the care plan is for you every year.
The disadvantage is, one of them, your assets are being used to pay for all of this, not only the guardian if they’re a professional, but also the attorney that represents the guardian. Your assets are being used to pay for all of this when really they should be used to pay for your care. The guardianship assets are in fact used for you, but one of the biggest disadvantages is it’s a costly process through the court system, and it’s not private.
