Can I have a durable power of attorney that becomes effective only in the future?
If you signed a durable power of attorney that’s effective in the future, if you signed it prior to October of 2011, it’s effective. Since 2011, the law has changed, and any document that you sign called a durable power of attorney is immediately effective upon signing, and your attempt to make it conditional or effective in the future is going to make that document invalid.
