Can all elder law attorneys handle all issues that come up in an elder law context?
Elder law attorneys do a significant amount of work for the elderly, but for example, if you are in a nursing home and you have an injury that is the result of the negligence of someone in that nursing home, not all attorneys that do elder law will actually be able to assist you with that malpractice claim against that nursing home.
The elder law attorney, however, typically has attorneys that they can refer you to. Another example that not all elder law attorneys participate in is elder exploitation, which is a very specific area of the law where somebody is abusing a power of attorney or they’re in fact taking assets away from you or unduly influencing you, and not all elder law attorneys do that.
Typically, an elder law attorney can assist in the planning of your estate for purposes of preservation of assets, and obtaining long term care government benefits.
